Unlawful burning, blasting or use of fireworks, welding torch, tarpot or other device; permits; exceptions; applicability; penalty.

Except as otherwise provided in this section and NRS 527.126 , it is unlawful for any person, firm, association, corporation or agency to burn, or cause to be burned, any brush, grass, logs or any other inflammable material, or blast with dynamite, powder or other explosive, or set off fireworks, or operate a welding torch, tarpot or any other device that may cause a fire in forest, grass or brush, either on the land of the person, firm, association, corporation or agency or on the land of another, or on public land, unless the burning or act is done under a written permit from the State Forester Firewarden or the State Forester Firewardens duly authorized agent and in strict accordance with the terms of the permit.

Written permission is not necessary:
(a) At any time during the year when the State Forester Firewarden determines that no fire hazard exists.
(b) To burn materials in screened, safe incinerators, or in incinerators approved by the local governmental jurisdiction, the State Forester Firewarden or the State Forester Firewardens duly authorized agent, or in small heaps or piles, where the fire is set on a public road, corrals, gardens or ploughed fields, and at a distance not less than 100 feet from any woodland, timber or brush-covered land or field containing dry grass or other inflammable material with at least one adult person in actual attendance at the fire at all times during its burning.
- This section does not prevent the issuance of an annual permit to any:
(a) Public utility covering its usual and emergency operation and maintenance work.
(b) Person who engages in agricultural production.

This section does not prevent the building of necessary controlled small camp and branding fires if caution is taken to make certain that the fire is extinguished before leaving. In any case where the fire escapes and does injury to the property of another, the escape and injury are prima facie evidence of a violation of this section.

The provisions of this section apply only to areas of land that are outside of incorporated cities and towns.

Any person, firm, association, corporation or agency violating any of the provisions of this section is guilty of a misdemeanor.

As used in this section:
(a) Agricultural production means an activity associated with the production of agricultural products for food, fiber, fuel or any other lawful use, including every process and step necessary and incident to the preparation, production and storage of agricultural products for human or animal consumption. The term includes, without limitation:
(1) Planting, harvesting or raising agricultural, horticultural, floricultural or viticultural crops, including, without limitation, fruits, vegetables, grains, seeds, nursery stock, plant products, plant by-products and plant compost;
(2) Breeding, raising, feeding or managing livestock, furbearing animals, fish, bees and any other animal or aquatic species, or any product thereof;
(3) The construction, expansion, use, maintenance or repair of an agricultural production facility;
(4) Processing and packaging; and
(5) Manufacturing feed for animals.
(b) Agricultural production facility means any structure or land that is used for the production of agricultural products, including, without limitation, a structure or land that is privately or publicly owned, leased or operated.

Complete front inner structure for a unibody means the weld-on structure of a vehicle, including, without limitation, the radiator support, left and right aprons, upper and lower rails and strut towers, designed and intended to be located forward of the cowl assembly.

Class A certification: Eligibility.
To be eligible for Class A certification, a licensed body shop must:

Comply with local zoning laws and possess all required local, state and federal licenses, registrations and permits.

Possess garagekeepers and workers compensation insurance.

Provide employees with continuing education and training in subjects and for periods of time as prescribed by regulation.

Have the ability to:
(a) Obtain proper specifications for each vehicle being repaired;
(b) Make three-dimensional measurements that are verified by a computer of each vehicle being repaired; and
(c) Hoist a vehicle for inspection.
- Perform a wide range of services for vehicles being repaired, including, without limitation:
(a) Alignment of the wheels of a vehicle that is verified by a computer;
(b) Stabilization of a vehicle through the use of a four-point anchoring system;
(c) Simultaneous adjustment of the exterior and undercarriage of a vehicle;
(d) Removal and reinstallation of a frame, suspension, engine or drivetrain component;
(e) Painting the exterior of a vehicle with a system for applying paint that provides a finish similar to the finish applied by the manufacturer;
(f) Inspection of airbags and other occupant restraint devices to the specifications of the manufacturer; and
(g) Welding, by a certified technician, with a gas metal arc welder or an inverter welder, as appropriate.
- Adhere to current federal, state and local safety requirements by:
(a) Performing repairs on an air-conditioning system using equipment approved by the United States Environmental Protection Agency;
(b) Performing repairs with emission-reducing equipment, as prescribed by regulation;
(c) Performing repairs with equipment that meets all safety requirements as prescribed by regulation; and
(d) Disposing of hazardous waste as prescribed by regulation.
- Ensure customer satisfaction by providing to each customer:
(a) A computer-generated estimate of repairs; and
(b) A written, limited lifetime warranty that is valid against workmanship defects.
- Have a system for documenting and maintaining customer complaints and responses to service.

Additional practices required during fire season; contents and observation of fire plan; rules and regulations.
- Every timber owner or operator operating during the fire season shall have a fire protection organization and program for the prevention and suppression of fires on operating areas. The timber owner or operator shall make immediate and continuing attack on all forest fires occurring in his or her operating area and upon adjacent lands owned or controlled by the operator, employing his or her normal logging crew and equipment to the extent necessary to suppress such fires, and he or she shall observe the following practices:
(a) Perform loading, equipment servicing, welding and other hazardous operations over bare ground that extends at least 10 feet on all sides from such operations.
(b) Obtain permits for blasting from the local forest officer, as required by law. A worker shall remain on the scene for at least 1 hour following any blasting.
(c) Each year the timber owner or operator shall give written notice to the State Forester Firewarden of the timber owners or operators intent to commence logging operations on a specified area, prior to the commencement of operations. The State Forester Firewarden shall then furnish a standard fire plan form which the operator shall fill out and return to the State Forester Firewarden not later than 10 days prior to commencement of operations.
- The fire plan shall be observed and shall include at least the following:
(a) Names of all personnel having responsibility in fire suppression, indicating their duties and line of authority.
(b) Location and number of persons ordinarily available for fire fighting.
(c) Arrangement for receiving reports of fires at any and all times during the dry season, and arrangement for summoning the crew both on and off shift.
(d) Lists showing the type, number and location of tools and equipment reserved for use only on fires, and, also, those units of regular operating equipment that may be used for fire fighting.
(e) Legal description of logging area.
- The State Forester Firewarden may promulgate such additional reasonable rules and regulations as he or she may deem necessary.

Permanently marked means prominently engraved, etched, welded, metal-stamped, acid-marked or otherwise permanently displayed using a similarly reliable method of imparting a lasting mark on the exterior case of a used catalytic converter.
